N.J. Admin. Code § 7:14A-15.7 - Statement of basis
(a) The Department
shall prepare a statement of basis when:
1.
It suspends or revokes an existing permit pursuant to
7:14A-16.6; or
2. It denies an application for a new permit
or permit renewal.
(b)
The statement of basis shall briefly describe:
1. The type of facility or activity which is
the subject of the permit application;
2. The type and quantity of wastes, fluids,
or pollutants which are proposed to be or are being treated, stored, disposed
of, injected, emitted, or discharged; and
3. The reasons supporting the decision to
suspend or revoke a permit, or to deny an application for a new permit or
permit renewal.
(c) The
Department shall send the statement of basis to the applicant, to the persons
identified in
7:14A-15.10(e)1
ii through v and, upon request, to any other person.
