N.J. Admin. Code § 7:14A-6.15 - Residuals management
(a) Where applicable,
the permittee shall comply with land-based sludge management criteria and shall
conform with the requirements for the management of residuals and grit and
screenings under:
1. Section 405 of the Federal Act
governing the disposal of sludge from treatment works treating domestic
sewage;
2. The Solid Waste Management
Act, 13:1E-1 et seq., and the Solid Waste
Management Rules, N.J.A.C. 7:26;
3. The
Sludge Quality Assurance Regulations, N.J.A.C. 7:14C;
4. The Statewide Sludge Management Plan
promulgated pursuant to the Water Quality Planning Act,
58:11A-1 et seq., and the Solid Waste
Management Act,
13:1E-1 et seq.; and
5. The provisions concerning disposal of sewage
sludge and septage in sanitary landfills set forth at
13:1E-42 and the Statewide Sludge
Management Plan.
(b) The
NJPDES permit shall specify standards for residual use or disposal, under Section
405(d) of the Federal Act and N.J.A.C. 7:14A-20, unless those standards have been
included in a permit issued under the appropriate provisions of subtitle C of the
Solid Waste Disposal Act, Part C of the Safe Drinking Water Act, the Marine
Protection, Research, and Sanctuaries Act of 1972, or the Clean Air Act, or under
State permit programs approved by the Department.
(c) When there are no applicable standards for
residual use or disposal, the permit may include requirements developed on a
case-by-case basis to protect public health and the environment from any adverse
effects which may occur from toxic pollutants in residual. If any applicable
standard for residual use or disposal is promulgated under section 405(d) of the
Federal Act and Sections 4 and 6 of the State Act and that standard is more
stringent than any limitation on the pollutant or practice in the permit, the
Department may initiate proceedings under these rules to modify or revoke and
reissue the permit to conform to the standard for residual use or
disposal.
