N.J. Admin. Code § 7:9A-4.5 - Surface drainage

(a) No disposal area shall be placed within a topographical depression or in any area where surface runoff or ground water is likely to accumulate unless measures adequate to address these limitations are incorporated in the approved engineering design and implemented when the system is constructed.
(b) The use of swales to divert surface run-off away from the disposal field shall be carried out only as prescribed within the engineering design which has been approved by the administrative authority.
(c) The system shall be designed in a manner that will prevent any increase in stormwater runoff to or ponding on adjoining properties as a result of the installation of the system. This shall include any additional runoff to adjoining properties during the construction of the system, unless a temporary increase in runoff is specifically agreed to in writing by all affected property owners prior to commencement of construction of the system and such an increase is not prohibited by other Federal, State, or local requirements.
