N.J. Admin. Code § 7:9B-1.6 - Establishment of water quality-based effluent limitations
(a) Water
quality-based effluent limitations shall be established for NJPDES point
sources in accordance with N.J.A.C. 7:14A.
(b) For new and/or expanding NJPDES point
sources, the water quality-based effluent limitations shall comply with the
antidegradation policies at
7:9B-1.5(d).
(c) Water quality-based effluent limits for
chlorine produced oxidants based on the criteria in
7:9B-1.14(f) are
not applicable where:
1. The aquatic
community of a waterbody is exposed to one or more point source discharges of
non-contact cooling water that is intermittently chlorinated to control
condenser biofouling;
2. The total
period of such exposure to chlorinated wastewater is two hours per day or less;
and
3. The maximum concentration of
chlorine produced oxidants in the effluents of such discharges shall not exceed
200 [micro]g/L.
(d) The
Department may authorize compliance schedules in accordance with individual
NJPDES permits to allow the permittee time to comply with new effluent
limitations.
