N.M. Code R. § 9.2.11.9 - PERSONS OR ORGANIZATIONS ENTITLED TO APPEAL
The following persons or organizations ("petitioners") have a right to a hearing:
A. Any applicant
for designation as a PSA, whose application is denied by the department,
according to 9.2.4.15 NMAC;
B. Any
affected party when the department initiates an action or a proceeding to
designate an additional PSA, divide the state into different PSAs, or otherwise
affect the boundaries of PSAs, according to 9.2.4.12(C) NMAC;
C. An area agency on aging when the
department proposes to:
(1) Disapprove an
area plan or plan amendment, according to Section F of 9.2.6.10 NMAC;
or
(2) Withdraw an area agency on
aging designation, according to 9.2.7.13 NMAC.
D. Any applicant for area agency on aging
designation denied designation, according to 9.2.5.17 NMAC.
