N.Y. Comp. Codes R. & Regs. Tit. 10 § 400.3 - Inspection, reproduction and reports
(a) The commissioner or his authorized
representative may inspect, reproduce, require reproduction of or require
reports on:
(1) any medical facility record,
report or other written document or report to or from an inspecting,
accrediting or certifying body which he may require for the purpose of
conducting cost analyses and studies of standards and procedures relating to
operating certificates, or certificates of approval under the provisions of the
Public Health Law; and
(2) any
patient medical record, clinical log or other patient record which he may
require for the purpose of conducting medical audits under the provisions of
paragraph (j) of subdivision 1 of section
206 and
article 28 of the Public Health Law; and
(3) the disclosure of any interest in the
operation of a medical facility or any interest in the ownership of the
property interests in a medical facility which he may require for the purpose
of conducting an analysis of the operation of medical facilities and standards
and procedures relating to operating certificates under the provisions of the
Public Health Law; and
(4) such
other medical facility records as may be required.
(b) The medical facility shall not charge the
commissioner or his authorized representative for the cost of reproducing any
records, reports or documents required by this section, but such reproduction
costs shall be an allowable expense of the medical facility for the purposes of
third- party reimbursement.
