N.Y. Comp. Codes R. & Regs. Tit. 10 § 412.3 - Inspection
Nothing in this Part shall be construed to limit the authority of the commissioner to inspect residential health care facilities pursuant to subdivision (1) of section 2803 of the Public Health Law and, in the instance of a facility participating in title XVIII and/or title XIX of the Social Security Act, for departmental certification of the facility for title XVIII and/or title XIX provider agreement purposes.
