N.Y. Comp. Codes R. & Regs. Tit. 10 § 77.9 - Tests prescribed by the commissioner for signs of death

The embalmer or funeral director, before proceeding either to embalm, remove, cremate or bury the body, shall determine that life is extinct by ascertaining that:

(a) pulsation has ceased in the radial or other arteries;
(b) heart and respiratory sounds are not heard with the use of a stethoscope or with the ear applied directly over the heart.
