N.Y. Comp. Codes R. & Regs. Tit. 16 §§ 720-2.4 - Short notice
(a) Except as
provided in section
720-2.3(b) of
this Subpart, the power of the Public Service Commission to permit changes in
existing schedules on less than 30 days' notice will be exercised only in cases
where an emergency or other justifying conditions are demonstrated.
(b) Any public utility desiring to change an
existing schedule on less than 30 days' notice shall file with the commission a
schedule, amendment, or supplement containing the proposed change, bearing an
effective date not less than 30 days after filing, and an application as
prescribed in section
720-2.5 of this Subpart requesting
authority to put such schedule, amendment, or supplement into effect at an
earlier date.
(c) If the
application is granted, a special permission order will be issued specifying
the date on which the schedule, amendment, or supplement shall become
effective.
(d) On schedules,
amendments, statements, supplements, or addenda authorized to be made effective
on less than 30 days' notice (10 days for telecommunications non-basic
service), a notation in the following form (on each leaf in the case of an
entire schedule) shall be shown:
EFFECTIVE under authority of PSC (order no.) made (order issuance date).
