N.Y. Comp. Codes R. & Regs. Tit. 18 § 441.1 - Applicability
The provisions of this Article, except as may be otherwise limited, shall apply, in appropriate part or parts, to all child-care agencies, facilities and programs, public and private, subject to visitation, inspection and supervision by the department.
