N.Y. Comp. Codes R. & Regs. Tit. 9 § 576.2 - Significant economic injury
(a) The
applicant may seek to prove, by specific financial documentation and expert
testimony, that the strict application of the relevant restrictions will result
in significant economic injury.
(b)
The testimony shall be limited to the effect of the restrictions upon the value
of the property in question; whether the value would be enhanced were a
variance granted shall not be relevant.
