N.Y. Comp. Codes R. & Regs. Tit. 9 § 9500.10 - Emergency projects

An emergency project which is immediately necessary for the protection of life or property shall not be subject to review. Any person undertaking a project which is believed to be an emergency project shall inform the commission by certified mail or telegram within 48 hours after the project is commenced. If the commission determines that such project is not immediately necessary for the protection of life or property and that it is subject to review, it shall so inform such person.
