10A N.C. Admin. Code 09 .0201 - INSPECTIONS OF CHILD CARE FACILITIES
The Division shall visit and inspect all child care facilities to ensure compliance with G.S 110, Article 7 and 10A NCAC 09.
(1) The Division shall make at least one
unannounced visit annually to ensure compliance with the licensure statutes and
as identified in this Rule.
(2) The
Division shall make an unannounced visit when the Division receives a complaint
alleging a violation of licensure statutes or rules or if the Division has
cause to believe an emergency exists at the facility in accordance with
G.S.
110-105.
(3) The Division shall conduct an announced
visit prior to the initial issuance of a license. The prospective licensee
shall be notified in advance about the visit.
(4) This Rule shall not apply to the
investigation of child care facilities that are operating without a license in
violation of the statute.
