Ohio Admin. Code 145-1-10 - Staff determination of membership
(A) Any affected person may request a
determination of membership by providing the public employees retirement system
with a written request and supporting documentation of the nature of work
performed for which a determination is requested.
(B) Upon receipt of a membership
determination request, the system shall review the submitted information and,
if necessary, request additional information from any party. The system shall
obtain certification from the public employer prior to issuing a determination.
Based upon a review of all information submitted, the system shall issue the
staff determination by certified mail to the impacted parties. Any affected
person may appeal the staff determination by
providing a written notice of
. An
appeal, together with additional supporting
information, shall be submitted in writing and received
by the system not later than thirty days after the issuance of the staff
determination.
(C) After submission
of a timely notice of appeal, the system shall review all information and issue
a senior staff determination. The senior staff membership determination may be
appealed as provided in rule
145-1-11 of the Administrative
Code.
