Ohio Admin. Code 3701:1-54-06 - Land disposal - purpose and scope
(A) The purpose of rules 3701:1-54-06 to
3701:1-54-12
of the Administrative Code is to establish procedures, criteria, and terms and
conditions upon which the department issues licenses for the land disposal of
radioactive waste received from another licensee and radioactive waste disposed
of in accordance with paragraph (C) of rule
3701:1-38-19 of
the Administrative Code.
(B) The
requirements of rules 3701:1-54-06 to
3701:1-54-12
of the Administrative Code are in addition to those in Chapter 3701:1-40 of the
Administrative Code, and other rules adopted pursuant to Chapter 3748. of the
Revised Code.
(C) The requirements
of rules 3701:1-54-06 to
3701:1-54-12
of the Administrative Code apply to a radioactive waste land disposal facility
used by more than one licensee to dispose of radioactive waste or to a licensee
that disposes of any radioactive waste at a location other than its currently
licensed facility.
(1) Rules 3701:1-54-06 to
3701:1-54-12
of the Administrative Code establish performance objectives and technical
requirements for the land disposal of radioactive waste received from another
licensee.
(2) The objectives are
to protect the public health and safety, to minimize exposures to ionizing
radiation, and not to adversely affect the environment from the land disposal
of radioactive wastes received from another licensee.
(3) The land disposal requirements in rules
3701:1-54-06 to
3701:1-54-12
of the Administrative Code are in addition to, and not a substitution for,
other applicable rules.
(4) Rules
3701:1-54-06 to
3701:1-54-12
of the Administrative Code do not apply to byproduct material as defined in
section 11e(2) of the Atomic Energy Act and codified in 42 U.S.C. 2014e(2).
(5) As used in rules 3701:1-54-06
to
3701:1-54-12
of the Administrative Code,"waste" means the same as "radioactive waste" as
defined in rule
3701:1-38-01 of the
Administrative Code.
(D) The requirements of rules 3701:1-54-06 to
3701:1-54-12
of the Administrative Code apply to radioactive waste disposal facilities
utilizing an above grade engineered structure.
