Ohio Admin. Code 3745-273-08 - Applicability- household and very small quantity generator waste

(A) Persons managing who manage the wastes listed in paragraphs (A)(1) to (A)(2) of this rule, at such person's option, may manage such wastes under Chapter 3745-273 of the Administrative Code as follows:
(1) Household wastes that are exempt under paragraph (B)(1) of rule 3745-51-04 of the Administrative Code and are also of the same type as the "universal wastes" defined in rule 3745-273-09 of the Administrative Code.
(2) Conditionally exempt Very small quantity generator wastes that are exempt under rule 3745-51-05 3745-52-14 of the Administrative Code and are also of the same type as the "universal wastes" defined in rule 3745-273-09 of the Administrative Code.

[Comment: Persons who store, treat, or dispose of conditionally exempt very small quantity generator wastes in Ohio, who are not the generator of that waste, and who do not manage those wastes under Chapter 3745-273 of the Administrative Code, are required to obtain an Ohio hazardous waste permit and to comply with the applicable requirements in Chapters 3745-50 to 3745-69, 3745-205, 3745-256, 3745-266, and 3745-270 of the Administrative Code.]

(B) Persons who commingle the wastes described in paragraphs (A)(1) and (A)(2) of this rule together with universal waste regulated under Chapter 3745-273 of the Administrative Code shall manage the commingled waste under Chapter 3745-273 of the Administrative Code.
