Ohio Admin. Code 3745-51-10 - Criteria for identifying the characteristics of hazardous waste
The director shall identify and define a characteristic of hazardous waste in rules 3745-51-20 to 3745-51-24 of the Administrative Code only upon determining that:
(A) A waste that exhibits the characteristic
may:
(1) Cause, or significantly contribute
to, an increase in mortality or an increase in serious, irreversible, or incapacitating reversible illness;
or
(2) Pose a substantial present
or potential hazard to human health or the environment when
it
the waste
is improperly treated, stored, transported, disposed of or otherwise managed; and
(B) The characteristic can be:
(1) Measured by an available standardized
test method which is reasonably within the capability of generators of waste or
private sector laboratories that are available to serve generators of waste;
or
(2) Reasonably detected by
generators of waste through knowledge of the wastes.
