Okla. Admin. Code § 35:1-9-24 - Informal disposition of an individual proceeding
(a) Informal disposition may be made of any
individual proceeding by stipulation, agreed settlement, consent order, or
default.
(1) Resolution by stipulation, agreed
settlement, or consent order shall be approved by the State Board of
Agriculture.
(2) Any Respondent who
fails to appear after receipt of notice may be determined to have waived the
right to appear and present a defense and a default may be presented by the
Department to the Board at a regularly schedule meeting proposing the relief
requested by the Notice of Violation.
(b) Proposed final administrative orders
shall be prepared and issued in accordance with the Administrative Procedures
Act and presented to the Board of Agriculture.
(c) Administrative penalties, civil
penalties, and other fines imposed by the Board shall be enforced pursuant to
the procedure outlined in 2 O.S. §
2-7(B)
and the Uniform Enforcement of Foreign Judgments Act, 12 O.S. §
719 et
seq.
