Effective 11-1-08, the authority to "adopt, amend, repeal, and promulgate rules as may be necessary to regulate . . . home inspectors" was transferred from the Oklahoma State Department of Health to the Construction Industries Board [see 59 O.S., § 1000.4]. The Construction Industries Board promulgated emergency rules, effective 11-14-08, and later superseded those emergency rules with permanent rules, effective 7-11-09 [see OAC 158:70 and 158:10-3-5]. As of the cutoff date for this 2011 Edition of the OAC, the Department of Health had not yet revoked the rules regulating home inspectors in this Chapter 276 or in Section 310:110-5-6.
