(1)
Payments to victims of Nazi persecution covered by Public Law 103 286 and
payments to victims of crime under 42 U.SC. 10602 (The Crime Act of 1984) are
excluded as income, and amounts retained are excluded as a resource as long as
the amounts are not commingled with other funds.
(2) For other types of victims' assistance
(not covered by section (1) of this rule):
(a) Payments that are considered a
reimbursement (see OAR
461-001-0000) for a lost item
are treated as provided in OAR
461-145-0440.
(b) Payments for pain and suffering are
treated in the same manner as personal injury settlements under OAR
461-145-0400.
