55 Pa. Code § 6000.1015 - Health care power of attorney
(a)
Unless otherwise specified in the health care power of attorney, a health care
power of attorney becomes operative when the following occurs:
(1) A copy is provided to the attending
physician.
(2) The attending
physician has determined that the principal is incompetent. See
20 Pa.C.S. §§
5422 and
5454(a) (relating to
definitions; and when health care power of attorney
operative).
(b) Unless
otherwise specified in the health care power of attorney, a health care power
of attorney becomes inoperative when, in the determination of the attending
physician, the principal is competent.
