55 Pa. Code § 6500.23 - Criminal history record check
(a)
An application for a Pennsylvania criminal history record check shall be
submitted to the State Police for individuals 18 years of age or older who
reside in the home, prior to an individual living or receiving respite care in
the home.
(b) If a person 18 years
of age or older who resides in the home is not a Pennsylvania resident, an
application for a Federal Bureau of Investigation (FBI) criminal history record
check shall be submitted to the FBI in addition to the Pennsylvania criminal
record check, prior to an individual living or receiving respite care in the
home.
(c) The requirements in
subsections (a) and (b) apply for any person 17 years of age or older who moves
into the home and any person who reaches the age of 18 years, after the
individual lives in the home.
(d)
Pennsylvania and FBI criminal history record checks shall have been completed
no more than 1 year prior to an individual living or receiving respite care in
the home.
(e) A copy of the final
reports received from the State Police, and the FBI if applicable, shall be
kept.
(f) If the home serves
primarily children,
