A. Complaints and
Routine Correspondence.
1. Complaints. Any
person who desires to register a complaint citing a violation of the Act or
this Part shall submit a written and signed letter of complaint to the
Director. All complaints shall be directed to:

Routine Correspondence. Routine correspondence, including all required
notifications and reports, shall also be directed to the address specified
above.
B. Penalties.
1. Civil Monetary Penalty. Subject to
§6.5.3(C)(3) of this Part, a person who discloses identifiable patient
safety work product and/or document log in a knowing or reckless violation of
§6.5.2 of this Part shall be subject to a civil monetary penalty of not
more than ten thousand dollars ($10,000) for each act constituting such
violation.
2. Relation to Health
Insurance Portability and Accountability Act. Penalties shall not be imposed
both under this Part and under the regulations issued pursuant to the Health
Insurance Portability and Accountability Act,
42 U.S.C. §
1320d-5 for a single act or
omission.
