S.C. Code Regs. 28-26 - Administrative Interpretations
A. Request for
Administrative Interpretation: Upon the written request of any person, or upon
his own initiative, the Administrator may issue an administrative
interpretation of any provision of the Code or any Rule or Regulation issued
pursuant thereto.
B. Contents of
Request: Requests for administrative interpretation shall clearly state:
(1) the precise questions posed;
(2) the opinion of the person requesting the
Interpretation;
(3) the basis of
such opinion including citation of all applicable statutory provisions, Rules,
Regulations or other provision of law.
C. Request for Reconsideration:
Administrative interpretations will be reconsidered upon the written request
for any person. Such requests must conform to the requirements of the section
as in B above.
D. Public Record of
Administrative Interpretations: The Administrator shall keep available in his
office for public inspection a copy of his administrative
interpretations.
