S.C. Code Regs. § 89-270 - Termination of Mining Operation
A.
The Department may declare a mining operation or a segment of a mining
operation terminated when no mineral has been excavated or extracted or
overburden removed or regraded for a period of twenty-four (24) consecutive
months.
B. At the request of the
operator and with the approval of the Department, an operation where no mineral
or overburden has been removed for twenty-four (24) consecutive months will not
be terminated if mining has not begun or if:
(1) Best Management Practices for sediment
and erosion control are installed to the extent feasible on disturbed
areas.
(2) Drainage control
structures such as culverts and ditches are properly installed and
maintained.
(3) Vegetation is
established and maintained as determined to be feasible.
