S.C. Code Regs. § 89-60 - Application Requirements for an Operating Permit
A. Section
48-20-70
of the Act states that any operator desiring to engage in mining shall make
written application to the Department on the forms furnished by the Department.
A completed application shall consist of:
(1)
One copy of the form entitled "Application for a Mining Permit".
(2) Two copies of the form entitled
"Reclamation Plan".
(3) One copy of
the form entitled "Land Entry Agreement-Owner" (MR-600) (if the mine operator
owns the land) or one copy of the form entitled "Land Entry
Agreement-Lessor/Lessee" (MR-700) (if the mine operator leases the
land).
(4) One copy of a letter
from an attorney attesting to the ownership of the property, ownership of
mineral rights and that the operator has acquired rights to mine the
property.
B.
Supplemental information may be required as part of the operator's application
or after the Department reviews the operator's application for permit. When
supplemental information is required, the Department shall state in writing to
the applicant the information required and the reason or reasons for requesting
such supplemental information. All supplemental information shall be submitted
in typewritten or hand printed form to the Department.
