S.D. Admin. R. 20:18:18:08 - Evaluation of modifications

The executive secretary may require transportation of not more than two working models of a modified slot machine or component to a game laboratory for review and inspection. The manufacturer must pay the costs. The game laboratory may dismantle the models and may destroy electronic components in order to evaluate the machine or component. The executive secretary may require the manufacturer to provide specialized equipment or the services of an independent technical expert to evaluate the modification.

The executive secretary must determine whether the requested modification of a slot machine is sufficiently different so that the modified machine should be treated as a new slot machine. If the executive secretary makes such a determination, the executive secretary must notify the manufacturer in writing. The manufacturer may file an application for approval of a new slot machine.
