Tenn. Comp. R. & Regs. 1200-38-01-.07 - MODIFICATION/TERMINATION/ENFORCEMENT
(1) If the Department determines that the
benefits no longer outweigh the disadvantages by clear and convincing evidence,
the Department may first seek modification of the Cooperative Agreement with
the consent of the parties.
(2) If
modification is not obtained, the Department may terminate the COPA by written
notice to the Certificate Holder and the Certificate Holder may appeal in the
same manner as if the COPA were denied.
(3) The COPA shall remain in effect until
such time as the Certificate Holder has submitted, the Department has approved
and the Certificate Holder has completed the Plan of Separation.
(4) Voluntary Termination. The Certificate
Holder shall notify the Department forty-five (45) days prior to voluntary
termination of the Cooperative Agreement.
