Tenn. Comp. R. & Regs. 1240-03-02-.01 - NECESSITY AND FUNCTION

The Department of Human Services has responsibility to determine eligibility for medical assistance in accordance with Title XIX of the Social Security Act. T.C.A. §§ 71-5-102, 71-5-104 and 71-5-106 empower the Department to comply with any requirement that may be imposed or opportunity presented by Federal law for the provision of medical assistance in Tennessee. Federal regulations set forth the mandatory and optional groups of the Medicaid Program [ 42 C.F.R. §§ 435.100, 435.200 and 435.300 ].
