Tenn. Comp. R. & Regs. 1240-04-05-.01 - PURPOSE AND SCOPE
(1) These rules
shall apply to all child care agencies licensed by the Department of Human
Services pursuant to T.C.A. §§
71-3-501 et seq. and to all
proceedings held before the Child Care Agency Board of Review established
pursuant to §§
71-3-501 et seq. Any conflict
between these rules and those governing specific classes of child care agencies
shall be resolved by reference to these rules.
(2) These rules establish procedures for the
application and issuance of licenses for child care agencies; the placement on
probation of a child care agency by the Department of Human Services; the
imposition of a civil penalty by the Department of Human Services against a
licensee of a child care agency, the summary suspension of licenses of child
care agencies and the denial, revocation, or restriction of licenses by the
Department of licenses of child care agencies licensed by the Department of
Human Services pursuant to T.C.A. §§
71-3-501 et seq.
(3) All persons or entities operating a
child-care center, a family-child care home, a group child care home, a drop-in
center as defined by T.C.A. §
71-3-501 and the rules of the
Department of Human Services must be licensed by the Department as provided by
T.C.A. 71-3-501 et seq. and the rules of the Department unless otherwise
exempted by T.C.A. §
71-3-503 and the rules of the
Department.
