1 Tex. Admin. Code § 55.409 - Rescinding Acknowledgment or Denial
Any signatory to an Acknowledgment of Paternity or Denial of Paternity may rescind an acknowledgment or denial through a certified entity providing such services. The rescinding party must:
(1) Complete a Rescission of Acknowledgment
of Paternity form.
(2) Mail copies
of the Rescission of Acknowledgment of Paternity form by certified or
registered mail to all people who signed the original Acknowledgment of
Paternity or Denial of Paternity and the Attorney General's Office, if
required.
(3) Submit to Texas
Department of State Health Services, Vital Statistics Unit:
(A) the original Rescission of Acknowledgment
of Paternity form; and
(B) the
original proof of mailing of the copies.
(4) Submissions to the Texas Department of
State Health Services, Vital Statistics Unit must be made by the date a
proceeding related to the child is initiated or the 60th day after the
effective date of the acknowledgment, whichever comes earlier.
