1 Tex. Admin. Code § 61.305 - Overpayments to Service Providers
(a) If a
service provider is overpaid or paid in error by the OAG for any reason, the
service provider shall voluntarily repay the overpaid amount as soon as
practicable upon discovering the overpayment or upon notification of the
overpayment by the OAG.
(b) The
amount of the overpayment to the service provider per CVC application will not
reduce the maximum amount available to the victim or claimant for an approved
application.
(c) The OAG, at its
discretion, may discontinue or suspend all current and future payments to a
service provider who has received a request for return of an overpayment until
the OAG is satisfied that the overpayment requirements have been met or the
service provider enters into an overpayment return arrangement.
(d) The OAG may pursue available
administrative or civil penalties as provided under Texas Code of Criminal
Procedure Articles 56.62, 56.63, and 56.64.
