(a) Texas Health and
Safety Code §
85.113
requires an entity that contracts with the Texas Health and Human Services
Commission (HHSC) to operate a program involving direct client contact to adopt
and implement human immunodeficiency virus (HIV) and acquired immune deficiency
syndrome (AIDS) workplace guidelines similar to the guidelines adopted by the
agency. A contractor operating a program involving direct client contact with
an individual must follow the HIV/AIDS Model Workplace Guidelines for
Businesses, State Agencies, and State Contractors listed on the Department of
State Health Services website.
(b)
Texas Health and Safety Code §
85.114
requires HIV and AIDS education for individuals served at SSLCs. HIV/AIDS
education, including risk reduction, must be tailored to each individual and
routinely made available to all individuals or their legally authorized
representative. If education cannot be provided, the reasons must be documented
in the individual's medical record.
