37 Tex. Admin. Code § 16.68 - Eligibility For Reinstatement After Lifetime Disqualification
(a) A person disqualified from driving a
commercial motor vehicle for life under Texas Transportation Code, §
522.081(d)
may apply to the department for reinstatement if:
(1) the person meets all requirements under
state and federal law to hold a commercial driver license (CDL);
(2) the person completes the required
state-approved education program identified on the application for
reinstatement; and
(3) at least ten
(10) years have passed from the effective date of the lifetime
disqualification.
(b) A
person seeking reinstatement under this section shall submit an application on
a form specified by the department. The form is located on the department's
website: http://www.dps.texas.gov/DriverLicense/.
(c) The department shall provide written
notice by email or first class mail of the approval or denial of an application
submitted under this section. The determination to reinstate or deny an
application by the director, or their designee, is final.
(d) An applicant who has been approved for
reinstatement is eligible to apply for a commercial learner's permit (CLP) to
test for a CDL.
