AGENCY SUMMARY

The Board for Protection and Advocacy has rulemaking authority for the Virginia Office for Protection and Advocacy, an independent state agency. The office is designated as the agency to protect and advocate for the rights of persons with mental, cognitive, sensory, physical or other disabilities and to receive federal funds on behalf of the Commonwealth of Virginia to implement the federal Protection and Advocacy for Individuals with Mental Illness Act, the federal Developmental Disabilities Assistance and Bill of Rights Act, the federal Rehabilitation Act, the Virginians with Disabilities Act and such other related programs as may be established by state and federal law. The board is authorized to promulgate regulations to carry out the provisions of Chapters 8.1 (§ 51.5-39.1 et seq.) and 9 (§ 51.5-40 et seq.) of Title 51.5 of the Code of Virginia.
