W. Va. Code R. § 171-2-15 - Rules Of Evidence And Procedure
In any hearing before the Commission, the common law rules of evidence and procedure shall apply insofar as they are applicable and are not in conflict with any specific statute, or any other rule or regulation adopted by the Commission.
