020-8 Wyo. Code R. §§ 8-3 - Underground Water Protected
(a) All waters,
including Groundwaters of the State, within the boundaries of the State of
Wyoming are the property of the State; and control of the beneficial use of
waters of the State resides with the Wyoming State Engineer.
(b) Nothing herein contained shall be
construed so as to interfere with the right of any person to use water from any
underground water source for any purpose identified in
W.S.
35-11-102 and
35-11-103(c)(i);
or to limit or interfere with the jurisdiction, duties or authorities of other
Wyoming State agencies or officials.
(c) Protection shall be afforded all
underground water bodies (including water in the vadose zone). Water being used
for a purpose identified in
W.S.
35-11-102 and 103(c)(i) shall be protected
for its intended use and uses for which it is suitable. Water not being put to
use shall be protected for all uses for which it is suitable.
