A Conditional Resident is a noncitizen who is granted permanent resident status on a conditional basis:
- If the noncitizen immigrated to the United States as a spouse of a U.S. citizen before the second anniversary of their marriage, the noncitizen will be a Conditional Resident.
- If the noncitizen has children, they also may be Conditional Residents.
- The investor visa (EB5 Investor) also grants conditional residency.
The Conditional Resident receives a green card valid for 2 years. In order to remain a permanent resident, the conditional resident must file a petition to remove the condition. This petition must be filed within the 90-day period immediately preceding the second anniversary of the date they were granted conditional permanent resident status. This date is usually the expiration date of your Permanent Resident Card.
