Cal. Code Regs. Tit. 3, § 10710 - Appeals - Conduct of Informal Hearing
Informal hearings shall be conducted as follows:
(a) The standard of proof to be applied by
the hearing officer shall be a preponderance of the evidence.
(b) The respondent may request a hearing by
phone by submitting the request with the appeal pursuant to section
10707.
(c) The hearing officer shall issue a written
decision:
(1) Within 30 calendar days after
the conclusion of the hearing;
(2)
That includes a statement of the factual legal basis of the decision;
and
(3) By personal service, mail,
email, or via facsimile, depending upon the method by which the appeal was
received.
(d) Review of
the department's decision may be sought by the respondent within 30 calendar
days from the date of the decision pursuant to section
1094.5
of the Code of Civil Procedure.
