312 IAC 29-3-3 - Waste prohibited

Sec. 3.
(a) An owner
or operator shall not commit waste.
(b) The following are not prohibited as
waste:
(1) The pumping or placement of fluids
for well stimulation conducted according to IC 14-37 and this
article.
(2) The burning of natural
gas in flares located a safe distance from the well by an owner or operator of
a well producing both oil and natural gas if it is not economical to market the
natural gas.
(3) The burning of
coal bed methane in flares located a safe distance from a coal bed methane well
by the owner or operator of a coal mine, or a designee of the owner or operator
of a coal mine, if either or both of the following apply:
(A) The burning is necessary to protect coal
miners' safety.
(B) It is not
economical to market the coal bed methane.
