Kan. Admin. Regs. § 4-4-953 - Time frames for construction plans; dry fertilizer
(a) Within
three years after approval of construction plans by the secretary, the owner of
each storage facility shall complete construction or installation of secondary
containment facilities required by K.A.R. 4-4-900 et seq.
(b) Within two years after approval of
construction plans by the secretary, the owner of each storage facility shall
complete construction or installation of loading and unloading pads required by
K.A.R. 4-4-900 et seq.
(c) The
secretary may grant additional time for construction or installation of storage
containers, structures, dikes, or other equipment for good cause upon receipt
of a written request. Such request shall state the reason for the additional
time and the amount of additional time needed. The request may be granted if
the request was made in good faith and the circumstances underlying the request
were beyond the control of applicant.
