N.J. Admin. Code § 7:14A-15.15 - Final permit decision and issuance and effective date of a permit
(a) The Department
shall issue a final permit decision after the close of the public comment
period. The Department also shall notify, in writing, the applicant or
permittee and each person who submitted written comments or requested notice of
the final permit decision. This notification shall include reference to the
procedures provided to the applicant or permittee and persons other than the
applicant or permittee for contesting the Department's decision on a
permit.
(b) A final permit shall
not become effective until 30 days from receipt by the permittee of the permit
except when:
1. An effective date is not
specified in the permit but the permit specifies that the permittee may request
the establishment of the effective date at a subsequent time;
2. A later effective date is specified in the
permit; or
3. The Department has
received no comment from persons other than the permittee on the draft permit
and an immediate effective date is requested by the permittee, in writing, and
the Department concurs.
(c) After the issuance of a final permit
decision:
1. A treatment works approval, if
required by
7:14A-22.3, shall be
obtained.
2. The permittee or any
other person considered a party to the action under
7:14A-17.3 may request an
adjudicatory hearing to contest the final permit decision in accordance with
7:14A-17.2.
